These terms govern the Lymark app (com.lycosteam.lymark) and this site, offered by 29.015.357 AMAD ALI HAMMOUD, CNPJ 29.015.357/0001-25, Avenida Ana Costa, 433, Gonzaga, Santos - SP. By creating an account or using the service you agree to what is written here, to the extent permitted by the mandatory law of your country.
Was die App tut
Lymark overlays time, date, weekday, address and a code on a photo or video, producing a new file with those facts in the pixels. On request it issues a file-integrity seal — whether the JPEG or MP4 is still the one that left the app — without certifying the scene. It is a field-record and proof-of-service tool.
Was die App nicht tut
Dieser Abschnitt ist der wichtigste dieser Bedingungen, und wir bitten Sie, ihn aufmerksam zu lesen.
- Die App bescheinigt nichts und beglaubigt nichts. Sie ist kein technisches Sachverständigengutachten, stellt keine öffentliche Urkunde aus und begründet keinen Sachverständigenbeweis. Der Stempel hält fest, was im Moment der Aufnahme angegeben wurde — er bestätigt nicht, dass es wahr ist.
- Alle Felder sind vom Nutzer änderbar. Uhrzeit, Datum, Adresse und Code lassen sich vor dem Exportieren frei ändern, aus einer Entwurfsentscheidung: Die Fachkraft muss eine Adresse korrigieren können, bei der das GPS sich geirrt hat. Die Folge ist, dass der gestempelte Wert wiedergibt, was der Nutzer zu stempeln beschlossen hat.
- Die Uhrzeit kommt von der Uhr des Geräts, die falsch stehen oder von Hand verstellt worden sein kann. Es gibt keine Synchronisierung mit einem vertrauenswürdigen Zeitserver.
- Die Adresse ist eine Schätzung. Die Genauigkeit hängt vom GPS-Signal und von der Datenbank des Kartendienstes des Betriebssystems ab.
- Der Fotocode ist keine notarielle Eintragung. Er ist eine zufällige Kennung für den internen Verweis, ohne jeden Beweiswert.
- The seal attests the file, not the scene. It checks whether the file changed after leaving Lymark. It does not prove that what appears in the picture happened, and it does not replace a notary, a notarial deed, C2PA or an ICP-Brasil certificate.
- Sending via WhatsApp or another chat may recompress the file. The ink on the image usually survives; checking the seal needs the original file, not the chat preview.
Wenn Ihr Anwendungsfall einen Beweis mit gegenüber Dritten durchsetzbarem Rechtswert verlangt, wenden Sie sich an eine notarielle Niederschrift oder an einen digitalen Zertifizierungsdienst mit Zeitstempel — Lymark ersetzt keines von beiden.
Ihre Verantwortung
- Sie sind allein verantwortlich für die Fotografien, die Sie aufnehmen, für den Inhalt, den Sie darauf stempeln, und für den Gebrauch, den Sie von den erzeugten Dateien machen.
- Beim Fotografieren von Personen, Eigentum oder Räumen Dritter liegt es bei Ihnen, die nötigen Erlaubnisse einzuholen und das Recht am eigenen Bild, die berufliche Verschwiegenheitspflicht und das brasilianische Allgemeine Gesetz zum Schutz personenbezogener Daten gegenüber den abgebildeten betroffenen Personen zu beachten.
- Es ist untersagt, die App zu nutzen, um einen falschen Nachweis herzustellen, jemanden in die Irre zu führen, die Ausführung einer nicht erbrachten Leistung vorzutäuschen oder irgendeine rechtswidrige Handlung zu begehen.
- Es liegt bei Ihnen, Sicherungskopien von allem zu behalten, was Sie für wichtig halten. Die App führt einen begrenzten lokalen Verlauf, der kein Backup ist.
Nutzungslizenz
Wir erteilen Ihnen eine persönliche, widerrufliche, nicht exklusive und nicht übertragbare Lizenz, die App zu installieren und zu nutzen, auch zu beruflichen Zwecken. Es ist nicht erlaubt, die App ganz oder in Teilen zu dekompilieren, zu verändern, weiterzuverbreiten oder zu vermarkten.
Ihre Fotos gehören Ihnen. Wir beanspruchen keinerlei Recht an den Bildern, die Sie aufnehmen oder erzeugen. Name, Marke und visuelle Identität von Lymark bleiben im Eigentum des Entwicklers.
Verfügbarkeit und Aktualisierungen
Die App wird in dem Zustand bereitgestellt, in dem sie sich befindet. Es gibt keine Garantie für unterbrechungsfreien Betrieb, keine für Kompatibilität mit jedem beliebigen Gerät und keine Zusage einer Frist für Korrekturen oder neue Versionen. Funktionen können geändert oder eingestellt werden.
Die Qualität des exportierten Bildes hängt vom Gerät und vom Betriebssystem ab und kann eine geringere Auflösung haben als die ursprüngliche Fotografie.
Haftungsbeschränkung
To the maximum extent permitted by applicable law, the developer is not liable for indirect loss, lost profits, lost data or harm from decisions taken on the stamp or the seal — including a dispute over a photo’s content.
This limit does not waive mandatory consumer rights: in Brazil, Law 8.078/1990; in the EU and EEA, EU consumer law; in the UK, the Consumer Rights Act; in Australia, the Australian Consumer Law; and any mandatory rule of your country. It also does not waive intent or gross negligence.
Beendigung
You may stop at any time: deleting the account erases its server data; uninstalling removes what was on the device. Pro is cancelled where the subscription was made: on the account page, if made through the site, or on Google Play, if made through the Android app. Pro then runs until the end of the period already paid. There is no surprise yearly charge on someone who chose monthly.

Anwendbares Recht und Gerichtsstand
Brazilian law applies, without prejudice to mandatory consumer and data-protection rules of the country of residence. Forum: the consumer’s domicile; otherwise Santos, Brazil.
Account, quota and subscription
The account is personal. The free plan allows twelve sealed exports in the life of the account, with no card. Lymark Pro lifts that cap while the subscription is paid, at the price of the country of access, charged by the payment processor. Yearly and monthly are distinct choices at checkout — one does not become the other without you choosing.
The price is shown before you pay. Cancellation: any time, for the future; no refund of the period already paid, except where mandatory consumer law requires it (withdrawal, service failure, defect). For a subscription made through the Android app, Google Play is the one that charges you, and a refund request also follows Google Play’s policy. Taxes and the payment method follow the processor and the law of the billing country.
Territory
The service is offered where offering it is lawful. We may refuse, suspend or limit accounts in sanctioned territories or where the offer would break applicable law. That is not a political judgement on regimes: it is the legal limit of the person providing the service.
