These terms govern the Lymark app (com.lycosteam.lymark) and this site, offered by 29.015.357 AMAD ALI HAMMOUD, CNPJ 29.015.357/0001-25, Avenida Ana Costa, 433, Gonzaga, Santos - SP. By creating an account or using the service you agree to what is written here, to the extent permitted by the mandatory law of your country.
What the app does
Lymark overlays time, date, weekday, address and a code on a photo or video, producing a new file with those facts in the pixels. On request it issues a file-integrity seal — whether the JPEG or MP4 is still the one that left the app — without certifying the scene. It is a field-record and proof-of-service tool.
What the app does not do
This item is the most important one in these terms, and we ask that it be read with attention.
- The app does not certify or authenticate anything. It is not a forensic examination, it does not issue a document with public faith and it does not constitute expert evidence. The stamp records what was entered at the moment of capture — it does not attest to the truth of that.
- Every field is editable by the user. Time, date, address and code can be changed freely before exporting, by design: the professional needs to be able to correct an address the GPS got wrong. The consequence is that the stamped value reflects what the user decided to stamp.
- The time comes from the device clock, which may be incorrect or may have been set by hand. There is no synchronisation with a trusted time server.
- The address is an estimate. Its accuracy depends on the GPS signal and on the database of the operating system’s map service.
- The photo code is not a registration at a notary’s office. It is a random identifier for internal reference, with no evidentiary value whatsoever.
- The seal attests the file, not the scene. It checks whether the file changed after leaving Lymark. It does not prove that what appears in the picture happened, and it does not replace a notary, a notarial deed, C2PA or an ICP-Brasil certificate.
- Sending via WhatsApp or another chat may recompress the file. The ink on the image usually survives; checking the seal needs the original file, not the chat preview.
If your use case requires evidence with legal force against third parties, seek a notarial deed or a digital certification service with a time stamp — Lymark is a substitute for neither.
Your responsibilities
- You are solely responsible for the photographs you capture, for the content you stamp onto them and for the use you make of the files generated.
- When photographing other people, their property or their premises, it is up to you to obtain the necessary authorisations and to observe image rights, professional secrecy and the General Personal Data Protection Law in relation to the data subjects portrayed.
- Using the app to fabricate a false record, to mislead anyone, to simulate the performance of a service that was not provided or to carry out any unlawful act is forbidden.
- It is up to you to keep backups of whatever you consider important. The app keeps a limited local history, which is not a backup.
Licence of use
We grant you a personal, revocable, non-exclusive and non-transferable licence to install and use the app, including for professional purposes. Decompiling, modifying, redistributing or commercialising the app, in whole or in part, is not permitted.
Your photos are yours. We claim no right over the images you capture or generate. The Lymark name, brand and visual identity remain the property of the developer.
Availability and updates
The app is provided as it stands. There is no guarantee of uninterrupted operation, of compatibility with each and every device, nor any commitment to a deadline for fixes or new versions. Features may be changed or discontinued.
The quality of the exported image depends on the device and on the operating system, and may be of lower resolution than the original photograph.
Limitation of liability
To the maximum extent permitted by applicable law, the developer is not liable for indirect loss, lost profits, lost data or harm from decisions taken on the stamp or the seal — including a dispute over a photo’s content.
This limit does not waive mandatory consumer rights: in Brazil, Law 8.078/1990; in the EU and EEA, EU consumer law; in the UK, the Consumer Rights Act; in Australia, the Australian Consumer Law; and any mandatory rule of your country. It also does not waive intent or gross negligence.
Termination
You may stop at any time: deleting the account erases its server data; uninstalling removes what was on the device. Pro is cancelled where the subscription was made: on the account page, if made through the site, or on Google Play, if made through the Android app. Pro then runs until the end of the period already paid. There is no surprise yearly charge on someone who chose monthly.
Changes to these terms
Changes will be published on this page with a new update date. Continued use after publication means agreement with the version in force.
Applicable law and forum
Brazilian law applies, without prejudice to mandatory consumer and data-protection rules of the country of residence. Forum: the consumer’s domicile; otherwise Santos, Brazil.
Account, quota and subscription
The account is personal. The free plan allows twelve sealed exports in the life of the account, with no card. Lymark Pro lifts that cap while the subscription is paid, at the price of the country of access, charged by the payment processor. Yearly and monthly are distinct choices at checkout — one does not become the other without you choosing.
The price is shown before you pay. Cancellation: any time, for the future; no refund of the period already paid, except where mandatory consumer law requires it (withdrawal, service failure, defect). For a subscription made through the Android app, Google Play is the one that charges you, and a refund request also follows Google Play’s policy. Taxes and the payment method follow the processor and the law of the billing country.
Territory
The service is offered where offering it is lawful. We may refuse, suspend or limit accounts in sanctioned territories or where the offer would break applicable law. That is not a political judgement on regimes: it is the legal limit of the person providing the service.
